2. Eligibility and United States Use

5. PCBuyer Tools, Automated Analysis, and AI-Assisted Results

PCBuyer may provide automated product analysis, computer-buying recommendations, product scores, AI readiness estimates, fair-price ranges, deal ratings, comparison results, warnings, alternative product suggestions, and other outputs generated from available data, third-party merchant information, user-submitted information, browser/device signals, public product specifications, automated rules, and/or artificial intelligence systems.

These tools and outputs are provided for general informational and educational purposes only. They are not professional, financial, technical, cybersecurity, legal, tax, accounting, business, or purchasing advice.

PCBuyer does not guarantee that any product is a good purchase, suitable for your specific needs, accurately described by a seller, compatible with your intended use, available at the displayed price, free from defects, or the best available option.

Automated and AI-assisted outputs may contain errors, omissions, outdated information, incorrect assumptions, incomplete analysis, or inaccurate product matching. 6. Browser Computer Test and Device Capability Estimates

Browser-based tests are limited by browser permissions, privacy settings, device settings, operating-system restrictions, and technical limitations. These tests may not accurately identify your exact processor, memory, graphics hardware, storage, installed software, battery health, operating-system configuration, or full system capabilities.

PCBuyer’s browser-based tests do not inspect your personal files, documents, photos, passwords, emails, private messages, local storage contents, or private local content outside the technical signals made available through your browser.

Results are estimates only and should not be treated as a complete technical audit of your computer.

7. Product Scores, Rankings, Blue Book Values, and Fair-Price Estimates

PCBuyer may display product scores, AI readiness grades, value ratings, rankings, “best” labels, deal ratings, fair-price ranges, Blue Book estimates, product comparisons, recommended alternatives, red flags, or similar evaluations.

These evaluations are editorial and/or algorithmic opinions based on available signals, which may include price, age, condition, specifications, product class, performance estimates, AI readiness, warranty information, merchant data, availability, popularity, seller signals, and other factors selected by PCBuyer.

Scores, ratings, rankings, fair-price ranges, and Blue Book estimates are not appraisals, guarantees, warranties, or promises of actual resale value, market value, trade-in value, replacement cost, performance, quality, or merchant reliability.

Product data changes frequently. PCBuyer may update, modify, remove, or revise any score, estimate, ranking, product profile, or recommendation at any time without notice.

8. Computer Value Blue Book Estimates

PCBuyer may provide used-computer value estimates, resale estimates, trade-in estimates, refurbished-market estimates, component-based value estimates, and other computer valuation tools.

These values are estimates only. They are not guaranteed offers to buy, sell, trade, or appraise any computer, laptop, desktop, tablet, component, accessory, or related device.

Actual value may vary based on condition, age, configuration, battery health, missing accessories, warranty status, location, demand, marketplace fees, shipping cost, seller reputation, cosmetic wear, operating-system support, repair history, and buyer interest.

9. Merchant Offers, Prices, Availability, and Product Data

The Site may display product prices, availability, images, specifications, seller names, shipping information, taxes, discounts, condition descriptions, ratings, reviews, delivery estimates, and other product or merchant information supplied by third-party merchants, affiliate networks, APIs, data feeds, users, public sources, or automated systems.

PCBuyer does not guarantee the accuracy, completeness, availability, or timeliness of any third-party product or merchant information. Prices, discounts, availability, shipping costs, taxes, seller terms, return policies, product details, coupons, and offers may change without notice.

PCBuyer may provide educational content, AI 101 lessons, build-your-own-computer resources, quizzes, progress tracking, certificates of completion, and related learning tools.

PCBuyer educational materials are provided for general informational purposes only. They are not a substitute for professional training, formal education, manufacturer documentation, electrical safety guidance, cybersecurity guidance, professional IT support, or expert technical assistance.

A PCBuyer certificate of completion indicates only that a user completed the applicable PCBuyer course, lesson sequence, or activity. It is not a professional license, industry certification, academic credential, employment qualification, continuing-education credit, or guarantee of technical competence.

13. Business Fleet Planner and IT Recommendations

PCBuyer may provide business computer planning guidance, fleet recommendations, refresh-cycle guidance, accessory suggestions, networking guidance, AI-readiness guidance, and possible referrals to third-party technology providers or consultants.

PCBuyer is not responsible for business losses, downtime, incompatibility, implementation issues, cybersecurity issues, vendor disputes, tax treatment, financing issues, or other losses arising from reliance on business fleet planning materials.

14. User Content, Submitted Listings, Reviews, and Feedback

The Site may allow users to submit product listing URLs, product descriptions, computer specifications, comments, reviews, ratings, feedback, questions, messages, deal tips, screenshots, or other information collectively, “User Content.”

You are solely responsible for your User Content. You represent and warrant that you own or have the necessary rights to submit your User Content and that your User Content does not violate these Terms, any third-party rights, or applicable law.

By submitting User Content, you grant PCBuyer a non-exclusive, worldwide, royalty-free, sublicensable, transferable license to host, store, reproduce, display, publish, excerpt, modify, analyze, create derivative works from, and otherwise use the User Content for operating, improving, promoting, and providing the Site and related services.

You may not submit User Content that is false, misleading, deceptive, defamatory, harassing, obscene, unlawful, infringing, malicious, spam, promotional without permission, or otherwise objectionable.

PCBuyer may remove, edit, refuse, moderate, or restrict User Content at any time, with or without notice, but has no obligation to monitor all User Content.

15. Reviews, Testimonials, and Endorsements

You may not submit fake reviews, paid reviews without disclosure, reviews by people who have not used the relevant product or service, undisclosed insider reviews, review manipulation, or content intended to suppress truthful negative reviews.

If you submit a review, testimonial, endorsement, or similar content, you must disclose any material connection you have to the product, merchant, manufacturer, seller, or service provider, including compensation, employment, ownership, family relationships, free products, discounts, gifts, or other incentives.

PCBuyer may remove or decline to publish reviews, testimonials, or endorsements that appear false, misleading, manipulated, promotional, unlawful, or otherwise inconsistent with these Terms.

16. Intellectual Property

The Site and its content, including text, graphics, logos, designs, layouts, software, code, data, product scoring systems, product analysis frameworks, images, videos, audio, icons, trademarks, trade names, databases, and other materials, are owned by PCBuyer or its licensors and are protected by copyright, trademark, database, trade secret, and other intellectual property laws.

You may access and use the Site for your personal, non-commercial use only, unless PCBuyer provides written permission for another use.

You may not copy, reproduce, modify, scrape, republish, upload, post, transmit, sell, license, distribute, frame, mirror, exploit, reverse engineer, or create derivative works from the Site or its content without PCBuyer’s prior written permission, except as permitted by applicable law.

All trademarks, service marks, logos, and trade names displayed on the Site are the property of their respective owners. Reference to third-party products, brands, merchants, or trademarks does not imply endorsement, sponsorship, or affiliation unless expressly stated.

17. Software and Site Tools

Any software, scripts, browser tools, calculators, product analyzers, scoring systems, APIs, code, downloadable materials, or other technical features made available through the Site are licensed, not sold, for your personal, limited, revocable, non-exclusive, non-transferable, non-commercial use.

You may not reverse engineer, decompile, modify, redistribute, resell, exploit, bypass, interfere with, overload, scrape, or use automated systems to access or misuse any software or tool provided by PCBuyer.

18. DMCA and Copyright Complaints

PCBuyer respects the intellectual property rights of others. If you believe material on the Site infringes your copyright, you may submit a notice to PCBuyer’s designated copyright agent.

19. Prohibited Uses

You agree not to use the Site for any unlawful, harmful, abusive, deceptive, fraudulent, infringing, disruptive, or unauthorized purpose.

You may not:

  • attempt to breach, test, bypass, or interfere with the Site’s security systems;
  • scrape, crawl, harvest, mine, extract, copy, or republish Site data without written permission;
  • use bots, spiders, automated scripts, automated queries, or bulk-access tools without written permission;
  • bypass rate limits, access controls, authentication systems, Cloudflare protections, firewall rules, bot protections, or usage restrictions;
  • interfere with or disrupt the Site, servers, networks, tools, APIs, forms, databases, merchant feeds, or third-party services;
  • upload malware, malicious code, tracking software, spyware, viruses, worms, ransomware, or harmful files;
  • send spam, unauthorized advertisements, deceptive messages, phishing communications, or fraudulent submissions;
  • impersonate PCBuyer, another user, a merchant, a manufacturer, or any other person or entity;
  • submit false, misleading, defamatory, obscene, harassing, infringing, unlawful, or malicious content;
  • use the Site to violate intellectual property, privacy, publicity, contractual, or other rights;
  • attempt to manipulate product scores, rankings, reviews, alerts, recommendations, certificates, or user interactions;
  • use PCBuyer tools to build a competing database, scraper, product feed, AI model, commercial service, affiliate site, or lead-generation service without written permission; or
  • use the Site in any way that violates applicable law or these Terms.

20. Unauthorized Access, Attacks, Spam, and Abuse Fees

20.1 Prohibited Conduct

You agree not to engage in, attempt, assist, encourage, facilitate, or enable any of the following activities against PCBuyer, PCBuyer.com, its servers, infrastructure, forms, content, tools, APIs, databases, affiliate systems, email systems, users, or third-party service connections collectively, “Prohibited Conduct”:

(a) unauthorized access attempts, including brute-force login attempts, credential stuffing, password guessing, or attempts to access administrative areas including /wp-admin/, /wp-login.php, /xmlrpc.php, private endpoints, restricted files, or non-public systems;

(b) vulnerability scanning, port scanning, fuzzing, automated probing, exploit testing, security testing, or penetration testing without prior written authorization from PCBuyer;

(c) injection attacks, including SQL injection, cross-site scripting, remote file inclusion, local file inclusion, command injection, template injection, header injection, request smuggling, or any attempt to inject malicious code, commands, payloads, scripts, or markup;

(d) spam submissions through comment forms, contact forms, registration forms, newsletter forms, tool inputs, product forms, review forms, feedback forms, or any other input mechanism, including automated bot submissions;

(e) denial-of-service activity, including flood requests, resource exhaustion, excessive automated traffic, abusive API requests, repeated failed login attempts, bandwidth abuse, or any conduct designed to degrade Site performance, availability, security, or reliability;

(f) scraping, crawling, harvesting, copying, or automated extraction of content, product data, merchant data, scoring logic, URLs, forms, email addresses, or user information in violation of these Terms, the Site’s robots.txt file, technical restrictions, or in a manner that imposes an unreasonable load on Site infrastructure;

(g) attempts to bypass, disable, evade, interfere with, or circumvent any security measure, access control, authentication mechanism, rate limit, firewall, Cloudflare protection, bot-detection system, abuse-prevention system, or usage restriction;

(h) email harvesting, contact information scraping, form harvesting, or any data collection conducted for spam, phishing, unsolicited communication, identity misuse, fraud, scraping, or commercial exploitation;

(i) use of stolen, leaked, guessed, fabricated, or unauthorized credentials to access any portion of the Site;

(j) spoofing, phishing, forged headers, deceptive referrers, fake user agents, domain impersonation, or unauthorized use of PCBuyer’s name, domain, trademarks, email systems, headers, logos, content, or identity;

(k) attempts to upload, store, execute, or deliver malware, backdoors, shells, malicious scripts, hidden redirects, unauthorized tracking code, or harmful files; or

(l) any conduct that violates the Computer Fraud and Abuse Act, CAN-SPAM Act, Digital Millennium Copyright Act, Massachusetts law, or any analogous federal, state, local, or international law.

20.2 Authorization and Acceptance

To the maximum extent permitted by law, by accessing, requesting, querying, crawling, submitting, posting, transmitting data to, or otherwise interacting with the Site, you agree to be bound by these Terms.

Any access to the Site following notice of these Terms, including through publication on the Site, inclusion in robots.txt, reference in security headers where technically feasible, or other reasonable notice, constitutes acceptance of these Terms.

Accessing the Site for the purpose of engaging in Prohibited Conduct is not authorized.

20.3 Liquidated Damages for Unauthorized Access, Hacking Attempts, Spam, and Abuse

You acknowledge and agree that Prohibited Conduct causes PCBuyer direct, indirect, operational, technical, investigative, administrative, and reputational harm that is difficult to calculate with precision.

Such harm may include, without limitation:

  • server resource consumption and bandwidth costs;
  • hosting, CDN, firewall, and security service costs;
  • security monitoring, incident response, and forensic analysis time;
  • mitigation, remediation, cleanup, and infrastructure hardening costs;
  • interruption or degradation of Site performance;
  • damage to forms, databases, logs, analytics, rankings, or email systems;
  • loss of user trust;
  • diversion of administrative and technical resources from normal business operations;
  • merchant, affiliate, or advertising disruption;
  • legal and enforcement costs.

Because actual damages from such conduct are inherently difficult to quantify, you agree that liquidated damages of one hundred United States dollars (US $100.00) per unauthorized attempt, request, connection, scan, login attempt, spam submission, injection attempt, exploit attempt, scraping request, abusive form submission, or other Prohibited Conduct incident constitute a reasonable pre-estimate of PCBuyer’s damages and are not intended as a penalty.

Each unauthorized request, login attempt, scan, injection attempt, spam submission, scraping request, connection attempt, payload submission, or other prohibited action may be treated as a separate incident giving rise to a separate $100.00 obligation.

For sustained, repeated, automated, distributed, scripted, or bot-driven attacks, each individual HTTP request, connection attempt, form submission, login attempt, query, scan, or payload delivery may be counted as a separate incident.

PCBuyer reserves the right to seek higher actual damages, statutory damages, attorneys’ fees, costs, injunctive relief, or any other remedy available by law or equity where permitted.

20.4 Additional Remedies

The liquidated damages described above are in addition to, and not in lieu of, any other remedies available to PCBuyer at law or in equity, including without limitation:

(a) temporary, preliminary, and permanent injunctive relief;

(b) recovery of attorneys’ fees, expert fees, investigation costs, and enforcement costs where permitted;

(c) statutory damages under applicable federal or state law;

(d) referral to law enforcement authorities;

(e) reporting the conduct to the offender’s internet service provider, hosting provider, VPN provider, domain registrar, employer, affiliate network, advertising network, or platform provider;

(f) reporting abusive IP addresses, domains, user agents, email addresses, payloads, timestamps, request patterns, and related technical indicators to abuse-prevention services, threat-intelligence services, security vendors, or public abuse databases, where permitted by law;

(g) blocking, rate-limiting, filtering, challenging, or banning IP addresses, user agents, countries, networks, ASNs, accounts, emails, domains, or traffic sources;

(h) preserving and using logs, request data, server data, and technical evidence for security, enforcement, legal, or investigative purposes.

20.5 Identification, Logging, and Security Monitoring

You acknowledge that PCBuyer may collect, log, review, retain, and disclose information reasonably necessary to detect, investigate, prevent, and respond to Prohibited Conduct.

Such information may include IP addresses, user agents, request headers, request bodies, URLs, referrers, query strings, timestamps, cookies, device/browser signals, behavioral patterns, form submissions, login attempts, and other technical information.

PCBuyer may use Cloudflare, hosting logs, WordPress security tools, spam-prevention tools, analytics, firewall services, malware scanners, rate-limiting tools, and other security services to protect the Site.

When you engage in Prohibited Conduct, you should have no expectation that abusive traffic, attack attempts, spam submissions, malicious payloads, or related technical indicators will remain private from PCBuyer, its service providers, law enforcement, or abuse-prevention services.

20.6 No Authorization for Security Testing

Nothing in these Terms grants permission to conduct vulnerability scans, penetration tests, exploit attempts, scraping, stress tests, bot testing, password testing, form abuse testing, or automated probing of the Site.

Security researchers, vendors, consultants, or other parties must obtain prior written authorization from PCBuyer before conducting any test that touches PCBuyer systems, infrastructure, forms, endpoints, or users.

20.7 Choice of Law and Venue for Abuse Matters

Any dispute arising from Prohibited Conduct, unauthorized access, hacking attempts, spam, scraping, security abuse, or enforcement of this Section shall be governed by the laws of the Commonwealth of Massachusetts, without regard to conflict-of-law principles, except where federal law applies.

You consent to the personal jurisdiction of the state and federal courts serving Worcester County, Massachusetts, and waive any objection to venue in such courts for claims involving Prohibited Conduct, unauthorized access, security abuse, scraping, spam, intellectual property misuse, spoofing, phishing, or urgent injunctive relief.

20.8 Severability of Abuse Fee Section

If any provision of this Section is held invalid, unlawful, or unenforceable, the remaining provisions shall continue in full force and effect.

If the liquidated damages amount is held excessive in any jurisdiction, the amount shall be reduced to the maximum amount permitted by law rather than voided entirely, where permitted.

21. Spoofing, Phishing, and Unauthorized Use of PCBuyer Identity

Unauthorized use of PCBuyer’s name, domain, trademarks, email systems, headers, logos, content, product data, Site design, forms, or identity for spoofing, phishing, spam, fraud, impersonation, fake ads, fake offers, malware delivery, or deceptive communications is strictly prohibited.

PCBuyer reserves all rights and remedies available under applicable law, including injunctive relief, damages, recovery of costs, blocking access, reporting abuse to service providers, and referral to law enforcement where appropriate.

22. Account, Form, and Submission Security

If the Site allows you to create an account, subscribe to alerts, submit forms, save course progress, generate certificates, submit listings, or use other interactive features, you are responsible for the accuracy of the information you provide and for maintaining the confidentiality of any login credentials or access methods associated with your use of the Site.

You agree to notify PCBuyer promptly if you believe your account, email subscription, submitted information, or interaction with the Site has been compromised or misused.

24. No Warranties

The Site and all content, tools, software, product information, merchant information, recommendations, scores, rankings, estimates, alerts, course materials, certificates, and services are provided on an “AS IS” and “AS AVAILABLE” basis.

To the maximum extent permitted by law, PCBuyer disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, reliability, security, compatibility, and uninterrupted or error-free operation.

PCBuyer does not warrant that the Site will be secure, uninterrupted, error-free, accurate, current, complete, free of harmful components, compatible with your device, compatible with your browser, or suitable for your intended use.

25. Limitation of Liability

To the maximum extent permitted by law, PCBuyer and its owners, officers, directors, employees, contractors, affiliates, licensors, service providers, and agents shall not be liable for any indirect, incidental, consequential, special, exemplary, punitive, or similar damages, including lost profits, lost revenue, lost savings, lost data, business interruption, reputational harm, purchase losses, product defects, merchant disputes, or damages arising from reliance on Site content or tools.

To the maximum extent permitted by law, PCBuyer’s total liability for any claim arising out of or relating to the Site or these Terms shall not exceed the greater of:

(a) the amount you paid directly to PCBuyer for the specific service giving rise to the claim during the six months before the claim arose; or

(b) one hundred dollars ($100).

Some jurisdictions do not allow certain limitations of liability. In those jurisdictions, PCBuyer’s liability is limited to the maximum extent permitted by law.

26. Indemnification

You agree to defend, indemnify, and hold harmless PCBuyer and its owners, officers, directors, employees, contractors, affiliates, licensors, service providers, and agents from and against any claims, liabilities, damages, losses, costs, and expenses, including reasonable attorneys’ fees, arising out of or relating to:

  • your use or misuse of the Site;
  • your violation of these Terms;
  • your User Content;
  • your violation of any law or third-party right;
  • your reliance on Site tools, scores, estimates, alerts, or recommendations;
  • your disputes with merchants, sellers, manufacturers, or third-party services;
  • your unauthorized use of PCBuyer’s intellectual property, systems, data, tools, or identity;
  • your scraping, spam, hacking attempts, unauthorized access, or Prohibited Conduct.

27. Governing Law, Arbitration, and Class-Action Waiver

These Terms shall be governed by the laws of the Commonwealth of Massachusetts, without regard to conflict-of-law principles, except where federal law applies.

Any dispute, claim, or controversy arising out of or relating to these Terms, the Site, or your use of the Site shall be resolved through binding arbitration in Massachusetts in accordance with the applicable rules of the American Arbitration Association, unless another forum is required by applicable law.

You and PCBuyer agree that any dispute shall be brought only in an individual capacity and not as a plaintiff, class member, or representative in any class, collective, consolidated, or representative action.

Nothing in this section prevents either party from seeking injunctive or equitable relief for misuse of intellectual property, unauthorized access, scraping, fraud, spoofing, phishing, security violations, spam, or other urgent harm.

28. Force Majeure

PCBuyer is not liable for delay, failure, interruption, or nonperformance caused by events beyond its reasonable control, including natural disasters, acts of government, war, terrorism, labor disputes, power failures, internet outages, hosting failures, Cloudflare outages, data-provider failures, cyberattacks, merchant-feed disruptions, affiliate-network disruptions, API outages, payment-processor issues, or other events outside PCBuyer’s reasonable control.

29. Changes to the Site and These Terms

PCBuyer may modify, suspend, discontinue, or replace any part of the Site at any time, with or without notice.

PCBuyer may amend these Terms from time to time. When material changes are made, we may provide notice by posting an updated version on the Site, sending an email, or providing another notice where appropriate.

Your continued use of the Site after updated Terms are posted means you accept the updated Terms.

30. Severability

If any provision of these Terms is found to be invalid, unlawful, or unenforceable, the remaining provisions shall remain in full force and effect.

If any provision is found unenforceable as written, it shall be modified to the minimum extent necessary to make it enforceable while preserving its intent to the maximum extent permitted by law.

31. Entire Agreement
